What’s wrong with European Competition Law?

I have uploaded a long presentation I prepared – but I did not present in its full length – for a seminar in Brussels last month. It is pretty provocative and disparaging against some of the fundamental tenets of the European Court of Justice and the European Commission doctrine in the interpretation of articles 101 and 102 – but also merger control – of the Treaty. The presentation is in english and starts with some comments about the “more economic approach” to competition law. As the reader will promptly notice, I agree with the WSJ proposition according to which european competition law has become a sort of intellectual summersault. Usual caveats apply. The presentation does not represent the official opinion of CMS. The catch-22 comparison is from RBB
